Cruise Conditions
Cancellation by guest
The following time frames govern Bay of Islands Rock Cruises Ltd’s
obligation to refund any payments made by you for the Overnight Cruise:
If you cancel more than 72 hours prior to departure Full Refund
If you cancel less than 72 hours prior to departure Forfeiture of the Full Price
If
you cancel your booking less than 72 hours prior to departure, Bay of
Islands Rock Cruises Ltd will make every reasonable effort to re-sell
your booking. However, Bay of Islands Rock Cruises Ltd is under no
obligation to take any extraordinary measures to try to fill your spot
on the trip.
Alteration or Cancellation by Bay of Islands Rock Cruises Ltd
All departures, activities & itineraries are subject to weather,
tides & sea conditions. Bay of Islands Rock Cruises reserves the
right to cancel any departure without prior notice in the interest of
passenger comfort and safety.
Minimum Numbers
All
Departures are subject to Bay of Islands Rock Cruises Ltd minimum
number of 10 guests being met. Should the minimum numbers not be
reached Bay of Islands Rock Cruises Ltd reserve the right to cancel the
trip and offer guests a full refund of the cruise price or transfer to
another cruise date.
Safety
Our valued guests are hereby made aware that our adventure activities
(kayaking, snorkeling, beach landing, treks) all have an element of
risk and are suitable for people of good health. Whilst we do
everything possible to safeguard our guests we cannot be held
responsible for personal injury due to the actions of our guests that
are beyond our control.
The
staff and management of Bay of Islands Rock Cruises Ltd take all
practicable steps to safeguard our guests. However, you must follow
our instructions and use the safety equipment provided at all times.
Adults accompanying any person under the age of 18 must ensure that the
underage person follows our instructions at all times. You must
release or indemnify Bay of Islands Rock Cruises Ltd and our staff
against any liability we incur to anyone else, resulting from your
failure to follow our instructions or the failure of any person
accompanying you under the age of 18 to follow our instructions.
We
reserve the right to withdraw any person who in our opinion is likely
to endanger themselves or others. We also reserve the right to cancel
the cruise if we become concerned for any reason for your safety or
that of any other person.
WARNING:
Under New Zealand law it is extremely unlikely that you will be able to
sue anyone if you are injured. In addition, New Zealand's accident
compensation scheme provides only limited assistance to visitors to New
Zealand who are injured. We strongly recommend that all visitors to
New Zealand have full insurance covering any injury they might suffer,
including medical treatment cover, before undertaking this activity.
EXCLUSIONS:
To the extent permitted by law, all our liability for damage to your
property, disruption to travel plans, or mental injury is excluded.
This exclusion is subject to any rights or remedies you may have under
the Consumer Guarantees Act 1993.
Please
inform Bay of Islands Rock Cruises Ltd of any medical conditions or
other information we need to know to include you safely in this
activity. For example: asthma, allergies, heart conditions, epilepsy
or pregnancy. You are entitled to access any information we hold about
you or to request its correction at any time.
Insurance
Your reservation of a trip with Bay of Islands Rock Cruises Ltd does
not include insurance of any type. All types of insurance are your
responsibility.
All luggage and personal effects are at all times your own responsibility.
Bay of Islands Rock Cruises Ltd will not be responsible for any loss, delay or costs connected with adverse weather conditions.
Licensing Regulations
Please
note due to licensing regulations absolutely NO alcohol is to be
brought aboard the vessel. We have full bar facilities aboard The Rock.
Families with Children
Families
with children of all ages are welcome on our cruises. However we
require that families with children under the age of 16 take a private
cabin for the comfort of both the children and the other guests onboard.
By making the reservation for a trip with Bay of Islands Rock Cruises Ltd, you agree to be bound by these Terms and Conditions.
Nature and being realistic
Out here in the Bay of Islands Mother Nature ensure that every trip is different. Each season of the year brings different conditions. Sometimes the fishing is easy, sometimes it rains, sometimes we see Orca. But anyway it happens it always seems to work out great. We look forward to meeting you and sharing a very special cruise with you.
